Refund policy

Consumers have a right of withdrawal according to the following provisions, whereby a consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business or profession:

  1. Cancellation Policy Right of Withdrawal You have the right to withdraw from this contract within fourteen days without giving any reason.

    The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the last goods.

    To exercise your right of withdrawal, you must inform us (kybun Joya Retail AG, Mühleweg 4, 9325 Roggwil TG, Switzerland, Tel.: 0041 58 329 40 00, Email: mail@kybun.ch) by means of a clear statement (e.g. a letter sent by post, fax or email) of your decision to withdraw from this contract. You may use the attached sample withdrawal form, but it is not mandatory.

    To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

    Consequences of Withdrawal If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

    You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

    You will bear the direct cost of returning the goods.

    You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

    Exclusion or Premature Expiry of the Right of Withdrawal The right of withdrawal does not apply to consumers who, at the time of the conclusion of the contract, are not nationals of a Member State of the European Union and whose sole residence and delivery address at the time of the conclusion of the contract is outside the European Union.

    Linked/Financed Transactions If you finance this contract through a loan and later revoke it, you are also no longer bound by the loan agreement, provided that both contracts form an economic unit. This is particularly to be assumed if we are your lender at the same time or if your lender makes use of our cooperation with regard to the financing. If the loan has already been received by us when the withdrawal becomes effective or when the goods are returned, your lender shall assume our rights and obligations under the financed contract in relation to you with regard to the legal consequences of the withdrawal or return. The latter does not apply if the present contract concerns the acquisition of financial instruments (e.g. securities, foreign exchange or derivatives). If you want to avoid a contractual commitment as far as possible, make use of your right of withdrawal and also withdraw from the loan agreement if you are entitled to a right of withdrawal for this as well.

    General Notes

    1. Please avoid damage and contamination of the goods. Please return the goods in the original packaging with all accessories and all packaging components. If necessary, use a protective outer packaging. If you no longer have the original packaging, please ensure suitable packaging to provide adequate protection against transport damage.
    2. Please do not return the goods to us freight collect.
    3. Please note that the above points 1-2 are not a prerequisite for the effective exercise of the right of withdrawal.

  3. Right of Withdrawal

    1. The customer is entitled to revoke their declaration of intent aimed at concluding the contract without stating reasons within 14 days after receipt of the goods in text form (e.g. letter, email) or by returning the goods to our dispatch address. The period begins at the earliest upon receipt of the goods. To comply with the withdrawal period, it is sufficient to send the withdrawal or the goods in time. The withdrawal in text form must be addressed to:

    The customer bears the burden of proof for the dispatch of the goods to be returned.

    1. In the event of an effective withdrawal, the customer is obliged to return the received goods. If the customer cannot return the received goods in whole or in part or only in a deteriorated condition, the customer must compensate kybun for the corresponding loss in value in the event of withdrawal. If the customer has already paid the purchase price, kybun is entitled to deduct the loss in value from the refund amount. In individual cases, the loss in value may correspond to the paid purchase price.

    2. The costs of the return shipment are borne by the customer, unless the delivered goods or service do not correspond to the ordered ones.

    3. In return, kybun will refund any purchase price already paid by the customer in the event of an effective withdrawal. Until the goods are fully returned, kybun will exercise its right of retention.
